NC law allows a sentencing judge to impose a jail sentence on a Class A1 misdemeanor, such as this Assault on Female. While it is more likely that he would be sentenced to probation + batterers' counseling if convicted, the judge does nonetheless have the discretion to put him in jail.
The batterers' program is rather intensive and could substantially interfere with his pro ball career. A conviction would also require under Federal Law that he not possess a firearm, such as the ones that he is alleged to have piled up on his futon.
