North Carolina man faces driving while impaired charges

A man is accused of causing a tragic accident that killed one woman and injured several others in North Carolina. Authorities allege the man was driving while impaired prior to the accident. The man was traveling toward the city of Cherryville when his Kia was said to have crossed over the center line. It apparently collided with a pickup truck head-on. Both the driver and passenger of the truck sustained serious injuries.

Another woman driving behind the pickup truck was also injured when her vehicle struck the man's Kia. The nature and extent of her injuries were not reported. The Kia driver suffered serious injuries and was transported to the hospital. Tragically, his female passenger passed away.

Police say the man was intoxicated and/or on drugs at the time of the accident. They were still investigating the crash and attempting to determine what the circumstances were surrounding the incident. The man has since been charged with driving while impaired, though no other details were provided. There are no reports on whether the man was given a blood alcohol test.

Although a tragedy has occurred, it does not mean the accused man was intoxicated at the time of this North Carolina crash. Deadly accidents can occur for any reason, and even simply taking one's eyes off of the road for one second can result in a tragedy. Nevertheless, the fact that a death and serious injuries resulted from the collisions mandates that the accused individual focus his attention on the criminal allegations, a conviction for which could have life-altering consequences for him. This man would do well to ensure he is aware of his legal rights as they relate to this case. While an allegation of driving while impaired involving a fatality is serious, it is still solely incumbent on the prosecution to sustain the allegations in court by a burden of proof that is defined as beyond a reasonable doubt.
