Late-night collision leads to drunk driving charges for 1

Being accused of driving under the influence of alcohol can be a stressful and intimidating process. The penalties for a DUI conviction are serious and only increase in severity if an accident occurs, perhaps especially one that ends in death. A man has recently been accused of drunk driving following a fatal accident involving a pedestrian in North Carolina.

According to reports, a woman was walking alongside a road just after 11 p.m. on a recent Saturday when she was struck from behind by a vehicle. Police claim the driver called in to report that he might have hit a pedestrian. Upon arrival, emergency responders pronounced the woman dead at the scene, and the man was arrested and faces charges for driving under the influence and felony death by vehicle.

It is unclear how authorities came to believe the man was intoxicated at the time of the collision. Although drivers have a duty of care regarding the safety of others, pedestrians must also practice due diligence, especially when walking late at night. Authorities assert the woman was walking with traffic instead of against it, and that the area was poorly lit, which could severely limit visibility.

Drunk driving charges of this nature carry serious penalties if a conviction is obtained, and those who face similar circumstances may find it beneficial to seek guidance as soon as charges are filed. By speaking with a defense attorney, a client in North Carolina could gain advice on making informed decisions throughout the process. An attorney can evaluate the incident in question, along with the charges and evidence against a client, and assist in forming a strong defense for use during legal proceedings.
